where is the bank one upstream sensor on a 2009 dodge challenger RT

have a code p0038 and p0032 and it says Heated Oxygen Sensor Heater Control Circuit High Bank 1 Sensor 1
would that be on the driver side?

Bank 1 is the passenger side of the engine and the sensor you will want to replace is the sensor BEFORE the catalytic converter on that side of the engine
