Just bought the car on the highway home i noticed the trans acting up. After a fluid and filter change ( with only normal signs of wear in the pan no metal or chunks and fluid clean and not burnt smelling) But after it warms up doesn't go in to first gear. Could this be a shift solenoid      Please help ........

Transmission fluid. you need to check for leaks, it low, P0730 this would be a shift solenoid, but it would also give the code to which solenoid. Your transmission fluid check it , it seems  low.

I already changed fluid and filter and topped it off when trans get to operating temp won't lock up in first gear let it cool down an hour works perfect till warms up again. could this be a solenoid, the car set six months with a dead battery could it need flashed

No you can not flash a transmission module if there is a solenoid at fault, whether it is a pending code or no code showing, this type of symptom that is exhibit is the transmission RPM sensor which is either the  input speed sensor and it is not too uncommon for this to be the output speed sensor. What you are describing is more likely the output speed sensor

I changed the output speed sensor still same problem. Shifts and goes into gear perfect when cold but won't shift to low gear after normal operating temp

When you fill the transmission , the output is right near it, when its cold and shift into gear until warm up these are the speed sensor , and the output speed sensor  are normally the cause this this is rare for the input speed sensor, Can you use a scan tool that is more VAG (volkwagon , Audi , group) and check if other code would set, such as P0705 which would be the gear selector switch , or input speed sensor code. As for solenoid it bring to mind the N-90 solenoid and when a N90 solenoid is set it goes in gear cold when warm it does not shift but defaults, and when the transmission is inspected it is always found that the transmission filter drop out of place,
