P048e code my auto is VW cheater

My Jetta is a (cheater) and will be turned in when I do not know yet. Fault coed keeps coming back P048e will it last to turn in.

P048E Exhaust pressure control valve position sensor circuit high

This code because the ECM see it as a disconnection , if you clear the code the ECM will still see this within the first ignition cycle of a start up, one of the job of the ECM is too look for open circuit , short circuit, grounded circuits, rationality , this code is a open circuit circuit either at the sensor or the sensor itself
