Would I get this engine code because I ran out of gas?

P0446 Evaporative emission control system vent control circuit malfunction

This is only possible condition , and it can be the case where there is no pressure for the fuel tank pressure to report, It usually is not the case when the fuel tank is less than 1/4 full the evap system does not run at all. The ECM monitor at all times looks for  open circuit and grounds and rationality at all times. very unlikely this will be running out of fuel.
